Free Sale Certificate for Cosmetic Export

What is CFS?
Te US cosmetic expert companies are often asked by importers to provide a Certificate of Free Sale (CFS) as part of their export documents. A Free Sale Certificate is a declaration that the exported cosmetic products comply with the US cosmetic products regulations and are legally sold and freely distributed across the United States. A free Sale certificate is also called as Export Certificate or Certificate to Foreign Government.

How can you request a Certificate of Free Sale in the United States?

US cosmetic companies can request a Certificate of Free Sale (CFS) from three different agencies:

1. The US Food and Drugs Administration( the FDA): Companies exporting cosmetic and personal care products from the United States are often asked by foreign importers to provide a Certificate of Free Sale as a requirement to import cosmetic products to their country. The FDA doesn’t require US companies to obtain a Free Sale certificate for the export of their cosmetic products from the United States. The US law doesn’t require the FDA to issue CFS for the export of cosmetic products, however, the FDA will continue to issue the export certificate when requested. The FDA charges $175.00 per certificate, the processing time is 3 weeks. Please be noted that you will be required to obtain certification (Apostille or embassy legalization) for your Certificate of Free Sale in order to be able to use the certificate outside the United States.

2. State Health Departments: Companies can request a certificate of Free Sale from the local health department in the same state where the company is registered. The prices and processing times vary depending on the state. Please be noted that not all importing companies will accept a Free sale certificate issued by the State level. Search for the export requirement of the importing company before you request your certificate.

3. American Cosmetic Manufacturers Association: US Companies can request a Certificate of Free Sale for the export of Cosmetic products from The American Cosmetic Manufacturers Association (ACMA). ACMA is a cosmetic trade association that provides Free Sale Certificates for the export of cosmetic products from the United States. The cst is $150.00 per certificate including the Apostille fees. The processing time is 2 business days. If you need embassy legalization on your free sale certificate, additional fees and processing time will apply.
